Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between Better Facilities Maintenance Ltd ("Company," "we," "us," or "our") and you ("Client," "you," or "your"). By accessing our website, requesting a quote, or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Service Description

Better Facilities Maintenance Ltd provides commercial facilities maintenance, repairs, and management services across the United Kingdom. Our services include:

  • Building maintenance and repairs
  • Emergency response services
  • Industrial facilities maintenance
  • Facilities management and planning
  • Commercial property maintenance
  • Specialized technical services

Services are provided subject to current availability, scheduling, and site-specific requirements.

3. Quotation and Service Agreement

3.1 All quotations provided are estimates and valid for 30 days from issue date unless otherwise specified.

3.2 Quotations are based on information provided by the Client and site conditions known at the time of quotation. Additional charges may apply if conditions change or additional work is identified.

3.3 A formal service agreement or work order must be executed before services commence. Verbal quotes do not constitute binding agreements.

3.4 The Client accepts our Terms of Service by accepting a quotation or signing a service agreement.

4. Pricing and Payment Terms

4.1 All prices are in GBP (British Pounds) unless otherwise specified and exclude VAT unless stated.

4.2 Payment terms are Net 30 days from invoice date unless a different arrangement is agreed in writing.

4.3 Invoices must be paid in full for services rendered. Late payment may result in:

  • Suspension of future services
  • Interest charges at 8% per annum on overdue amounts
  • Recovery of collection costs

4.4 Emergency or additional work beyond the agreed scope requires written authorization and will be charged separately.

5. Scheduling and Cancellation

5.1 Service dates and times are scheduled based on our availability and the Client's requirements.

5.2 The Client must provide reasonable access to the site and notify us of any hazards, restrictions, or changes in advance.

5.3 Cancellation by the Client:

  • Cancellations made 7+ days before scheduled service are free
  • Cancellations made 3-7 days before are subject to 50% of estimated cost
  • Cancellations made less than 3 days before are charged at 100% of estimated cost

5.4 The Company may cancel or postpone services with 48 hours notice due to circumstances beyond our control.

6. Liability and Insurance

6.1 Better Facilities Maintenance Ltd carries full public liability and professional indemnity insurance. Insurance certificates are available upon request.

6.2 The Client is responsible for:

  • Providing accurate information about site conditions and hazards
  • Ensuring the site is safe for our personnel to access
  • Maintaining appropriate insurance for their property and operations

6.3 Our liability is limited to the value of services provided in the preceding 12 months, except for death or personal injury caused by our negligence.

7. Warranty and Guarantees

7.1 We guarantee that all work will be performed professionally and to industry standards.

7.2 Labor warranty: We warrant our workmanship for 12 months from completion. Material warranties are provided by manufacturers.

7.3 Warranty does not cover:

  • Damage caused by Client negligence or misuse
  • Weather-related damage after service completion
  • Work modified by unauthorized parties
  • Maintenance procedures not followed by Client

8. Health and Safety

8.1 All work is performed in compliance with UK Health and Safety regulations.

8.2 The Client must immediately halt services and notify us of any unsafe conditions. We do not proceed with work until the site is made safe.

8.3 The Client is responsible for ensuring PUWER, LOLER, and other statutory compliance for equipment we service.

8.4 Any injury or incident on site must be reported immediately and documented.

9. Confidentiality

9.1 We agree to maintain the confidentiality of proprietary information shared by the Client.

9.2 We may use site photos and project descriptions for marketing purposes unless explicitly prohibited by the Client in writing.

10. Dispute Resolution

10.1 Any disputes arising from these Terms or our services shall be resolved through:

  • Good faith negotiation between parties (14 days)
  • Mediation if negotiation fails
  • Binding arbitration or court proceedings as a final resort

10.2 These Terms are governed by the laws of England and Wales.

11. Limitation of Liability

To the maximum extent permitted by law, Better Facilities Maintenance Ltd shall not be liable for:

  • Loss of business, revenue, or profits
  • Indirect or consequential damages
  • Damages beyond the contract value
  • Client claims for third-party damages

12. Modifications to Terms

12.1 We reserve the right to modify these Terms at any time. Changes will be effective 30 days after posting.

12.2 Your continued engagement of our services constitutes acceptance of modified Terms.
